Former President Trump Seeks High Court Permission for State Guard Personnel in Illinois

Judicial Challenge Over Guard Activation

The White House has claimed that troop deployment is needed to reduce protests and bolster deportation efforts.

At the core of the legal battle is the government's invocation of a national law allowing the executive branch to federalize the military reserve only in instances of rebellion or when “powerless with the federal troops to execute the laws of the United States”.

The government maintains that the personnel are required to defend federal property and personnel from activists.

Earlier this month, the White House took control of three hundred members of the Illinois military reserve and directed additional Texas-based personnel into the region.

As local leaders denounced the move, the president increased his statements, demanding the detention of the mayor of Chicago and the Illinois governor, each a Democrat, charging them of neglecting to secure federal agents.

State authorities and Chicago filed a combined lawsuit the White House to block the sending.

On the ninth of October, Judge April Perry, a Biden appointee, issued a preliminary order stopping the order.
